1. Why is it important to consider?
Because the Supreme Court has suspended the way in which until now the City Councils calculated the municipal capital gain and therefore now it is calculated differently.
2. What changes have taken place?
a) One of the most important is that if the sale of the property does NOT result in an increase in assets (monetary gain between purchase and sale) the City Council can no longer collect the capital gain.
b) If there is an increase in assets, but not enough to pay the Municipal Capital Gains, in this case the City Council cannot collect the Capital Gains.
c) Finally, if there is an increase in assets, there are two systems for calculating capital gains, the objective and the real.
3. How does this change affect you?
It is necessary to calculate which of the two systems is more beneficial for the taxpayer and ask the City Council to apply it. We can find great differences.
